Warranty Deeds

The preferred way to transfer ownership of a property is via a warranty deed because it offers the buyer the most protections. A general warranty deed assures that the seller has the right to sell the property and that the property is free and clear of all debts or liens.

Quit Claim Deeds

A written deed is signed and recorded to transfer real estate in Tennessee. With no guarantee or title covenants, a quitclaim deed in Tennessee transfers the present owner’s entire interest in the land. 2 Any ownership stake that the present owner (the grantor) is able to transfer legally is transferred to the new owner (the grantee). However, the grantor does not guarantee to the grantee that the property’s title is legitimate or that it is free from liens and other potential title issues.

Trust Deeds

For real estate transactions, trust deeds transfer the legal title of a property to a third party until the borrower repays their debt to the lender. The property is held in trust by a neutral and independent third party until the loan is paid off. Roughly 20 states still mandate the use of a deed at this time. The remaining states use standard mortgages.
